These Terms and Conditions are provided by KP Aesthetics Ltd, trading as Hale Private Clinic (referred to as we, us, our or the Clinic), a company registered in England and Wales under company number 12249816. KP Aesthetics and Hale Private Clinic are the same organisation.

These terms cover two things: the terms on which we provide our clinic and treatment services to you (Part A), and the terms on which you may use our website at haleprivateclinic.co.uk and kpaesthetics.co.uk (Part B). Part C sets out general terms and our company details.

Our services fall into two types, and it is important to understand who you are contracting with. Non-surgical treatments are provided directly by the Clinic, and the patient and treatment terms in Part A apply to them. Surgical procedures are carried out by independent consultant surgeons who hold practising privileges with us and who use our facilities under a separate agreement. For a surgical procedure, your contract for the surgery, including the surgical fee, consent, and any deposit or cancellation terms, is with your treating surgeon, who will provide you with their own terms. We provide the hospital facilities and clinical support, and we remain responsible for the safety and quality of those facilities as a provider registered with the Care Quality Commission.

By booking a treatment with us, or by using our website, you accept these terms. We may update them from time to time, and the current version will always be available on request and on our website. These terms should be read alongside our Privacy Policy and our Patient Privacy Notice.

Part A: Patient and treatment terms

A1. Consultations and bookings

Consultations are charged at £50 and are non-refundable. This includes an in depth assessment of your skin using digital imaging technology and a bespoke treatment plan.

Please provide a full and accurate medical history when asked. To the extent permitted by law, we will not be liable for harm that results from information being withheld from us, or from a failure to follow the aftercare we provide. This does not limit our liability for death or personal injury caused by our negligence, or for fraud.

Please avoid alcohol for 48 hours before and after treatment.

A2. Pricing

The prices in this section apply to the non-surgical treatments we provide directly, such as injectables, skin treatments and device based treatments.

We reserve the right to change our prices. Following an in depth consultation, we will recommend a treatment plan and give you the price for the treatments recommended. You pay for the treatments you have, Any price quoted to you at your consultation takes precedence over prices quoted on our website or elsewhere. Please see our prices page for current treatment prices.

Your treatment price covers the agreed treatment and any products used to deliver it, together with any review that forms part of that treatment as clinically appropriate. It does not cover additional treatments beyond what was agreed at your consultation, or the correction of treatments carried out elsewhere or by another provider. Where a private prescription is necessary as part of your care, the cost of this is charged to you.

Surgical patients pay their consultant directly for surgical treatment. Where our clinic nurses provide pre-operative or post-operative support to a surgical patient, this is arranged with and charged to the consultant, not to the patient. If a surgical patient requires a compression garment as part of their post-operative aftercare, they may purchase this from us directly.

A3. VAT

Many of our consultations and treatments are provided for a medical purpose, such as the protection, maintenance or restoration of health, and where the relevant conditions are met these may be exempt from VAT. Treatments that are cosmetic rather than medical in purpose may be standard rated for VAT. Where VAT applies, it will be shown and added at the applicable rate. The VAT treatment of any particular service is determined in line with HMRC rules and the circumstances of your care.

A4. Payment and insurance

We accept most major debit and credit cards, including Visa and Mastercard. We no longer accept cheques. Payment must be made in advance or at the time of your appointment. Card payments are processed securely through our PCI compliant payment provider, and full card numbers are not stored by us.

Our non-surgical aesthetic treatments are self-funded and are not covered by private medical insurance. Where surgical or medical care is funded by private medical insurance, you must provide the required insurer details and obtain any authorisation your policy needs before treatment. Depending on the care, your insurer may be billed by us or by your treating consultant. You remain responsible for any amount your insurer does not pay, including any excess, any shortfall, or any care not covered. Full details are set out in our Billing Terms.

A5. Suitability, results and refusal of treatment

We have a strict patient selection process to make sure that patients are medically suitable for a given treatment. We may advise, in your best medical interests, that a treatment is not appropriate for you. We will also not proceed where we believe your expectations exceed the results that a treatment can achieve.

Results and expectations. Treatments affect everyone differently and individual results vary. While we will always discuss with you what a treatment can realistically achieve, we cannot guarantee a specific result or outcome. A course of treatment may be recommended, and results may take time to show and may not be permanent.

A6. Patients under 18

We do not provide treatments to anyone under the age of 18, with the following exception. Laser Hair Removal and Lumecca are available to patients aged 11 and over. These are cosmetic treatments rather than medical treatments. They are always provided with the consent of a parent or guardian, following consultation, and at the discretion of the treating clinician.

A7. Refunds and product returns

If you are unable to complete a course of treatment for medical reasons, we will consider a partial refund on receipt of a letter from your doctor setting out the medical reasons you cannot continue. We will not consider refunds on treatments more than 6 months after the date of purchase. An administration fee of £50 applies to refunds. We do not refund discounted packages.

We sell skincare and other retail products in clinic only, not online. As these are bought in person, we do not offer refunds or exchanges on products if you simply change your mind.

This does not affect your legal rights. If a product is faulty, not as described, or not fit for purpose, you are entitled to a refund, replacement or repair under the Consumer Rights Act 2015. Please return it to us with proof of purchase.

For health and hygiene reasons, skincare products that have been opened or unsealed cannot be returned or exchanged unless they are faulty. Prescription-only products cannot be returned or resold once they have been dispensed, unless they are faulty.

Nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015. Where a service has not been carried out with reasonable care and skill, your statutory remedies continue to apply.

A8. Booking deposits, cancellations and missed appointments

To secure your appointment, we hold a £50 deposit on account. This acts as security for your bookings, and when you attend it is credited towards the cost of your treatment.

We operate a 48 hour cancellation policy for non-surgical appointments. If you cancel with less than 48 hours notice, or do not attend, your £50 deposit is retained. Our appointments are in high demand, and a missed or late-cancelled appointment is a slot we could have offered to another patient. The retained deposit reflects a reasonable estimate of this cost to us, and you will be asked to provide a new deposit to make a further booking.

For clients on a course of treatment who repeatedly arrive late, fail to attend, or cancel outside the cancellation policy, we reserve the right to deduct one session from the course.

Where there are repeated late cancellations or missed appointments, we may ask you to pay for your treatment in full in advance in order to secure any future booking. Because our appointments are in high demand and a missed slot could have been offered to another patient, if you then do not attend we will retain an amount that reflects our reasonable loss, which may be up to the full cost of the booked treatment, and refund any balance to you.

Your £50 deposit is held on account and is valid for 12 months from the date it is paid. If within that time you have not made or attended a booking, and you have not used or claimed your deposit, it will expire and is non-refundable. We are not able to remind individual patients, so please keep a note of when your deposit was paid and use it within 12 months.

Cancellation or rearrangement of a surgical procedure is dealt with under the terms provided by your treating surgeon.

A9. Gift vouchers

Gift vouchers are valid for 12 months from the date of purchase, unless otherwise stated. Vouchers are non-refundable and non-transferable, cannot be exchanged for cash, and cannot be used to buy further gift vouchers. No cash or credit is given for any unused portion. Lost, stolen or expired vouchers are not replaced. Vouchers must be presented at the time of booking or payment.

A10. Your personal information

We use your personal information to provide your care, including pre-treatment and post-treatment advice, and we may share it with the clinicians and organisations involved in your care for that purpose. We will only use your contact details to send you marketing or information about other services where you have agreed to receive this, and you can opt out at any time. Full details of how we use and protect your information are set out in our Privacy Policy and our Patient Privacy Notice.

A11. Complaints

We are committed to providing a professional service. If you are unhappy with your treatment or the service provided, please speak to a member of staff at the clinic or call 0161 359 8889. You can also email all complaints, whether about surgical or non-surgical care, to admin@haleprivateclinic.co.uk. We will deal with any concerns promptly and in line with our complaints procedure.

If we are not able to resolve your complaint to your satisfaction, you may refer it to the Independent Sector Complaints Adjudication Service (ISCAS), of which we are a member, for independent external review. You may also raise concerns about the quality or safety of your care with the Care Quality Commission, although the CQC does not investigate individual complaints.

Part B: Website terms of use

B1. Introduction and acceptance

These website terms govern your use of our website. By using our website you accept these terms in full, including any future updates. If you do not agree with these terms, you must not use our website. You must be at least 18 years of age to use our website, and by using it you confirm that you are.

B2. Definitions

In these website terms: Website means haleprivateclinic.co.uk and kpaesthetics.co.uk, or any website that replaces them. We, us and our means KP Aesthetics Ltd. You means a user of the Website. Personal Information means the details you provide to us. Cookies means small text files placed on your device to store information about your use of the Website. United Kingdom means England, Wales, Scotland and Northern Ireland.

B3. Registration and accuracy of information

If you provide information to us through the Website, you confirm that it is true, accurate, current and complete, and you agree to tell us promptly of any changes by email or by calling 0161 359 8889 during our normal opening hours. For non-surgical appointments please use appointments@kpaesthetics.co.uk, and for surgical matters please use admin@haleprivateclinic.co.uk. You agree not to impersonate any other person or to use a name you are not authorised to use.

B4. Intellectual property and permitted use

All copyright, trademarks and other intellectual property rights in the Website and its content belong to us or our licensors, and all rights are reserved. The content is made available for your personal, non-commercial use only. You may view, download for caching purposes, and print pages for your own personal use.

You must not republish, sell, rent, sub-license, publicly display, reproduce, duplicate, copy, exploit for commercial purposes, edit, or otherwise modify our content, except where we have expressly made content available for that purpose. Competitor businesses must not register as a patient in order to obtain information about our products and services.

B5. Acceptable use

You must not use the Website in any way that damages it or impairs its availability, or for any unlawful, fraudulent or harmful purpose. You must not introduce viruses or other malicious software, and you must not carry out any systematic or automated data collection (such as scraping, data mining or harvesting), or attempt to probe, scan or test the security of our systems, or reverse engineer any software underlying the Website, without our express written consent. You must not use the Website for marketing purposes without our express written consent.

B6. Limited warranties

We do not warrant the completeness or accuracy of the information on the Website, and we do not guarantee that the Website will always be available or kept up to date. To the maximum extent permitted by law, we exclude all implied warranties and conditions relating to the Website and its use. The information on the Website is provided for general information and educational purposes only. It is not a diagnosis and is not a substitute for professional medical advice. You should always check with a healthcare professional if you have any concerns about your health.

B7. Limitations and exclusions of liability

Nothing in these terms will limit or exclude our liability or your liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything that cannot lawfully be limited or excluded.

Subject to that, and to the extent the Website and its information are provided free of charge, we will not be liable for any loss or damage of any nature, for losses arising from events beyond our reasonable control, for loss or corruption of data or software, or for any special, indirect or consequential loss or damage.

B8. Indemnity

To the extent permitted by law, you agree to indemnify us against any losses, claims, damages, costs, liabilities and expenses (including reasonable legal expenses) that we incur arising out of your breach of these website terms.

B9. Changes to the Website and termination

We may modify or discontinue all or part of the Website at any time, with or without notice. We may also decline to provide Website services to you if we believe you have acted inconsistently with these terms or our policies, or where we are unable to verify information you have provided. Nothing in this clause affects our duty of care to you as a patient. Any decision about your clinical care will be made and managed safely, in line with our clinical and regulatory obligations.

B10. Social media content

If you communicate with us across our social media channels, including Instagram, LinkedIn and Facebook, you grant us the right to use content and handles that you have tagged or mentioned us in, on our website and social media channels, royalty-free, and you confirm that you own that content and have the right to share it, that it does not infringe the rights of others, and that you are 18 or over.

This does not apply to your clinical care or to any clinical or before and after images of you. We will only ever use clinical images with your separate, explicit and written consent, which you can refuse or withdraw at any time, and which is dealt with under our Patient Privacy Notice.

B11. General website terms

No failure by us to enforce a term is a waiver of that term. If any provision is found to be unlawful or unenforceable, the remaining provisions continue in effect. We may transfer our rights and obligations under these terms; you may not transfer yours without our consent. These terms are between you and us and are not intended to be enforceable by any third party. Together with our Privacy Policy, these terms form the entire agreement between you and us in relation to your use of the Website.

B12. Variation

We may revise these website terms from time to time. The revised terms apply from the date they are published on our website, so please check this page regularly.

B13. Governing law and jurisdiction

These terms are governed by the law of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. The Website may only be used for lawful purposes.

Part C: General terms and our details

C1. Your statutory rights

Nothing in these terms reduces your rights under consumer protection law, including the Consumer Rights Act 2015. Where these terms conflict with your statutory rights, your statutory rights take precedence.

C2. Billing

On registration, a current copy of our billing terms will be provided to you. Any changes to our billing terms, and the date they take effect, will be notified to patients.
